Terms of Service

1. Definitions
"Service" refers to the Menu5Star platform accessible at https://www.menu5star.com, including all features for creating and managing digital menus, orders, payments, and analytics.
"User" refers to any natural or legal person who registers and uses the Service.
"Subscription" refers to the pricing plan chosen by the User (Starter, Pro, Business).
2. Acceptance
By registering for the Service, the User fully accepts these Terms of Service, the Privacy Policy, and the Cookie Policy. Use of the Service is subject to such acceptance.
3. Service Description
Menu5Star provides a SaaS platform for creating, managing, and publishing digital menus for restaurants and food service businesses. The Service includes, depending on the chosen plan: multilingual menu creation, QR code generation, order management, graphic customization, usage analytics, and payment system integrations.
4. Registration and Account
- The User must provide truthful and up-to-date data at registration.
- The User is responsible for the security of their login credentials.
- Each account is personal and non-transferable.
- We reserve the right to suspend or delete accounts that violate these Terms.
5. Plans and Subscriptions
- Starter (free): basic features with limitations (max 15 products, 1 language, basic template).
- Pro (€20/month): advanced features, unlimited products, premium themes, AI translations.
- Business (€40/month): everything in Pro + delivery order management, integrated payments, 2 QR codes.
Pro and Business plans include a 14-day free trial. At the end of the trial period, the User must make payment to continue using the chosen plan features. Without payment, the account will be automatically downgraded to the Starter plan.
6. Payments
- Payments are securely processed through Stripe. Prices are expressed in Euros (€).
- Subscriptions renew automatically on a monthly basis unless cancelled.
- No refunds are provided for partial periods, except as provided in the SLA section.
- In case of non-payment, access to premium features will be suspended after a 7-day grace period.
7. SLA (Service Level Agreement)
We commit to guaranteeing a Service uptime of 99.5% on a monthly basis. In case of Service interruption exceeding 24 consecutive hours (documented through a support ticket), the User will be entitled to a proportional refund for the unavailability period. Scheduled maintenance interruptions (communicated with at least 24 hours' notice) are not considered for SLA calculation purposes.
8. Limitation of Liability
- Menu5Star is not responsible for service interruptions caused by: User's Internet connectivity issues, network infrastructure failures not attributable to the provider, cyber attacks, force majeure events (natural disasters, pandemics, government actions, wars, strikes).
- The maximum liability of Menu5Star is limited to the amount of the last 3 months of subscription paid by the User.
- Menu5Star is not responsible for lost profits, indirect or consequential damages arising from the use or inability to use the Service.
9. User Content
The User retains all rights to uploaded content (photos, texts, logos). The User grants Menu5Star a limited license to display and distribute such content solely for the purpose of providing the Service. The User is responsible for the legality of uploaded content.
10. Intellectual Property
The Service, software, design, logos, and all Menu5Star materials are protected by intellectual property laws. Unauthorized reproduction, modification, or distribution is prohibited.
11. Cancellation
The User may cancel their subscription at any time from their dashboard. Cancellation will take effect at the end of the current billing period. User data will be retained for 30 days after cancellation, after which it may be deleted.
12. Jurisdiction and Applicable Law
These Terms are governed by Italian law. For any dispute, the Court of Bari shall have jurisdiction, except for mandatory consumer protection provisions. The parties commit to attempting amicable resolution of any disputes before resorting to judicial proceedings.
13. Changes
We reserve the right to modify these Terms. Significant changes will be communicated via email with at least 30 days' notice. Continued use of the Service after modification constitutes acceptance of the new Terms.
